What kind of patent exists ?

What a patent is made of ?

In the European Union your patent will be composed of

  • a request for grant : the “request for a grand” is the legal part of the patent. It is highly formalized and should comprise of a various legal references, including a full list of the European text and a general abstract upon which you find you claim.
  • a description of the invention

  • a concluding abstract.

 

Applications can be filed at the EPO in any language of the EU. However, the official languages of the EPO are English, French and German. If the application is not filed in one of these languages, a translation has to be submitted.

The services of a professional representative are mandatory for applicants residing outside Europe, the EPO advises all applicants to seek legal advice.

 

 

In the US and in Canada, to fill out your patent application, this patent will have :

      • A legally and economically sound conclusion that sums up the advantages of the invention.
      • Drawings of your invention. You can hire a patent illustrator to help you with this. In the specification, you can include notes on the drawings.
      • Claims. Claims describe which parts of your invention you want to be protected by the patent. There can be both independent claims and dependent claims. Dependent claims are connected to the independent claims. Your lawyer can give you guidance on how narrow or broad your claims should be.

    • A patent application declaration, which says that you truly invented your product

How long does it take to get a patent ?

It depends on where you ask it.

The INPI (the French patent office) and the Irish patent office are known to be relative fast (a few months), while the Italian and the German patent office are a bit slower.
In general, don’t expect your application to receive a quick response. Most patents take at least 6 month to a year to get approved.
In some cases, it may take up to three or four years before you are the proud owner of a patent. European process have included that delay : European patent application is published – normally together with the search report – only  18 months after the date of filing or, if priority was claimed, the priority date.
