What kind of protection does a patent offer ?

It will depend of the country and type of patent as you can see here

For example, the european legislation((http://documents.epo.org/projects/babylon/eponet.nsf/0/5837DA4C63F75B90C12583CC00503FA3/$File/EPC_16th_edition_2016_en.pdf)) is not at all the same of the USA laws((https://www.uspto.gov/web/offices/pac/mpep/consolidated_laws.pdf)).

In principle, the patent owner has the exclusive right to prevent or stop others from commercially exploiting the patented invention. In other words, patent protection means that the invention cannot be commercially made, used, distributed, imported or sold by others without the patent owner’s consent.

Patent are a subset of industrial industrial property right, the most important of them all.

Is a patent valid in every country ?

Effectiveness of patents

patent effectiveness

As you can see, patents are territorial rights.

In general, the exclusive rights are only applicable in the country or region in which a patent has been filed and granted, in accordance with the law of that country or region.

However, patent are covered by the Paris convention, that most country worldwide have signed (you can find here the list of signatories parties.((https://www.wipo.int/export/sites/www/treaties/en/documents/pdf/paris.pdf))

The Paris convention protects your work in most countries , but only if your patent is correctly redacted and with  the selection of the correct solutions during the application process !

Eternos Corporation will complete the demand with the best means that your patent will be protected in most of the countries.

What kind of patent exists ?

  • Utility patents are the most common. They cover inventions that have a specific function.Software patents are a type of utility patent, though some people place them in their own category. A utility patent is valid for 20 years in the US,  after we file the application (or for 17 years after the application is approved, whichever is longer), but only if you submit the required maintenance fees.

  • Design patents cover non-functional parts of items, such as aesthetic features.

  • Plant patents protect new plants.

Do not mix patents up with other parts of intellectual property law, such as trademarks and general copyrights.

Each of these is governed by different laws and legal cases.

How to apply for a patent ?

Before applying for any patent, we must make serious researches.

This is the first and most technical part of the patent processing.
You must consider applying for an international patent. This is possible thanks to the patent cooperation treaty.

We will file one application, and 149 countries will simultaneously consider that application.

International patent are even more technical than “normal one” since the burden of proof is much heavier.

Then we must fill a patent application to your local patent office, and wait for a first answer (réponse de principe in French, the original text of the Paris Convention), which tells you it your patent is outright rejected.

Then, when your patent is accepted in its principle, it is then examined.

Only then your patent is considered upon its own merits !

In the European Union your patent will be composed of

  • a request for grant : the “request for a grand” is the legal part of the patent. It is highly formalized and should comprise of a various legal references, including a full list of the European text and a general abstract upon which you find you claim.
  • a description of the invention
  • claims
  • drawings (if any)
  • a concluding abstract.

Applications can be filed at the EPO in any language of the EU. However, the official languages of the EPO are English, French and German. If the application is not filed in one of these languages, a translation has to be submitted.

The services of a professional representative are mandatory for applicants residing outside Europe, the EPO advises all applicants to seek legal advice.

In the US and in Canada, to fill out your patent application, this patent will have :

    • The specification. In this section, we will give enough details about your invention that someone with average skill in your industry would be able to make your invention based on your instructions. The specification includes :
      • An abstract, which is a brief preview of the rest of the specification. You can also mention your invention’s title. Abstract must show at least that the patent covers innovation.
      • Background information, which outlines what need your invention fills or what problems it solves.
      • A summary, or a brief explanation of your invention and what it does.
      • A detailed description of your invention. It should discuss the field the invention belongs in and give information on how someone might construct the invention. It should also state the industrial application of the invention.
      • A legally and economically sound conclusion that sums up the advantages of the invention.
      • Drawings of your invention. You can hire a patent illustrator to help you with this. In the specification, you can include notes on the drawings.
      • Claims. Claims describe which parts of your invention you want to be protected by the patent. There can be both independent claims and dependent claims. Dependent claims are connected to the independent claims. Your lawyer can give you guidance on how narrow or broad your claims should be.

We can submit your application via mail or fax but eFiling is easier.

Along with your application, we should also send :

    • Filing fees
    • A patent application declaration, which says that you truly invented your product
    • An information disclosure statement, which provides any extra relevant information. For example, we can talk about patent applications that we know are similar to yours

If you wish, we can submit a non-publication request.

It depends on where you ask it.

In general, don’t expect your application to receive a quick response. Most patents take at least 6 month to a year to get approved.
In some cases, it may take up to three or four years before you are the proud owner of a patent. European process have included that delay : European patent application is published – normally together with the search report – only  18 months after the date of filing or, if priority was claimed, the priority date.

Yes, all inventors must be listed on the patent application. Being on a patent opens up the possibility to obtain rights from it.

What is the patent process like in other countries ?

Every country has its own guidelines.

In Europe, most patent work the same, aligned with the EPO system.

In the US, your application should have a description of your invention, information about the specific parts of your invention that you want the patent to protect, and a brief summary of your invention.

If you want to get a patent for your invention in another country after you file an application in the US, be sure to file your foreign application within 12 months of when you file in the US. Otherwise, your own invention might be used against you as prior art.

I’m employed, can I apply for a patent ?

Yes ! Except is the US and a few common law countries.

In the US, be sure to check your company policies.
Usually, if you invent something while you are on the job, your employer will own it, not you. Some companies require that you tell them about anything you invent and get permission to pursue your project, even if the invention is unrelated to your industry.
